Copyright and Evidence Statement

This statement sets out the ownership of copyright in user works, and the nature of evidence anchoring and the effect of on-chain records, so as to dispel the misconception that "anchoring amounts to rights confirmation."

I. Copyright Ownership

1.1 The works, files, and the copyright, neighboring rights, and other related rights embodied therein that you create or upload while using AmberVouch belong to you or the entity that lawfully enjoys such rights. The platform does not claim, acquire, or hold on your behalf any copyright in any user work.

1.2 You shall make a true commitment as to the ownership of the content you upload; where ownership defects cause a third-party claim or loss to the platform, you shall bear full liability.

II. Evidence Anchoring Is Not Copyright Registration

2.1 The evidence anchoring, hash verification, trusted timestamp, and blockchain on-chaining provided by AmberVouch serve only to prove that "specific content already existed at a certain moment and has not been altered," constituting reliable electronic data retention for the convenience of subsequent enforcement and proof.

2.2 The above anchoring does not constitute copyright registration, nor does it create, establish, or confirm copyright ownership. The acquisition, ownership, and disputes of copyright are determined in accordance with the Copyright Law of the People's Republic of China and relevant laws and regulations.

2.3 The platform does not make a substantive determination or warranty as to whether the anchored content constitutes a work, enjoys copyright, or infringes the rights of others.

III. Blockchain On-chain Note

3.1 The consortium chain accessed by this platform is a state-recognized judicial evidence consortium chain, used for tamper-resistant retention, time anchoring, and public verification of electronic data. The platform is merely the technical access party to such consortium chain; whether on-chain evidence is accepted by a competent authority is determined by it in accordance with the law.

3.2 The platform does not issue, trade, or speculate in any virtual currency or tokens, nor does it provide any fundraising, securitization, or financial-derivative services related to virtual currency. Any statement that misconstrues this platform's anchoring service as a virtual-currency activity is inconsistent with the facts.

3.3 You shall not anchor content that you know is not created by you or that you are not entitled to dispose of. Where the platform discovers false, malicious, or impersonated ownership anchoring, it has the right to delete the relevant data, disconnect the display, and pursue your liability under this agreement.

IV. The Platform Does Not Claim Rights in Anchored Content

4.1 The platform merely acts as a technical service provider to retain the anchored data you select, and does not claim any copyright or other proprietary rights in such data.

4.2 Except as required by law, by judicial/administrative order, or as agreed in this agreement, the platform will not use your anchored content for commercial purposes unrelated to the authorization you have granted.

V. Authorized Use and Enforcement Authorization

5.1 To the extent necessary to provide you with the services of evidence anchoring, display, verification, and enforcement assistance, you authorize the platform to use your anchored content within the scope necessary to achieve the above service purposes; such authorization is a non-exclusive, non-transferable ordinary license to use, and terminates upon termination of the service. The platform will only entrust service providers to process data to the extent necessary to complete technical processing (such as encrypted cloud storage and hash on-chaining), and require them not to use or sublicense your anchored content independently.

5.1.1 Conflict of rights: where you separately enter into an exclusive authorization or exclusive transfer contract with a third party in respect of the same anchored content, such contractual relationship shall be handled by you and the other party on your own, and is independent of and does not affect the service authorization of this platform; the platform will not, by virtue of this authorization, assert externally any right conflicting with your exclusive authorization.

5.2 You may separately authorize the platform, where you suffer infringement, to send infringement notice letters and lawyer's letters in the platform's name, or to participate in corresponding enforcement procedures. The scope, term, and manner of such authorization shall be subject to the content separately confirmed by you.

VI. Infringement Complaints

6.1 If you believe content on the platform infringes your legitimate rights and interests, please submit a complaint in accordance with the Anti-infringement Complaints Guide. Upon verification, the platform will take necessary measures such as deletion and link disconnection in accordance with the law.

Important note: Anchoring is important evidence for enforcement, but not the right itself. If you encounter infringement, please promptly fix the evidence in combination with the Anti-infringement Complaints Guide and enforce your rights in accordance with the law.
