AmberVouch attaches great importance to the protection of intellectual property rights. If you believe content on the platform infringes your legitimate rights and interests, please submit a complaint in accordance with this guide, and we will handle it promptly and in accordance with the law.
Version v1.0 · Effective date 2026-09-26 · Last amended 2026-09-26
This guide applies where you believe content (including text, images, audio/video, code, etc.) uploaded, published, or traded by a platform user infringes the following rights of yours: copyright (including the right of communication through information networks), trademark rights, patent rights, portrait rights, reputation rights, name rights, and other legitimate rights and interests.
II. Complaint Materials
The complaint notice must include the following. Where materials are incomplete, the platform will notify you to supplement them, and will not process the complaint during the supplementation period:
(1) Complainant's entity information and supporting documents
Individual complaint: the right holder's real name, contact telephone number, email, and mailing address, together with a photo or scan of the ID card (for PRC citizens) or passport (for foreign citizens);
Entity complaint: the right holder's name, domicile, contact person, contact telephone number, email, the complaint notice (with official seal affixed), and a copy of the business license (with official seal affixed);
Authorized complaint: in addition to the materials above, a power of attorney signed or sealed by the right holder and the trustee's identity document must also be provided.
(2) Preliminary proof of infringement
Proof of rights: a copyright registration certificate, trademark right certificate, or patent right certificate issued by a competent authority, or valid materials that prove your rights, such as the date of first public publication/distribution of the work or the creation manuscript;
Description of infringement: a sufficient and clear description of the allegedly infringing content, specifying the particular right infringed, together with the exact name and network address (URL) of the complained-of content;
Where available, please also submit comparative materials (e.g., a comparison between the original draft and the allegedly infringing content).
III. Complainant Warranties
The complainant undertakes that:
The statements in the complaint notice and the attached materials are true, valid, and lawful;
Where the platform deletes or disconnects links pursuant to the complaint notice and thereby causes any loss to the platform (including claims by the complained-of party, reputational damage, etc.), the complainant shall bear compensation liability;
Where a wrongful complaint by the complainant causes the platform to delete content or disconnect links by mistake, causing loss to the complained-of party or other users, the complainant shall bear full compensation liability.
IV. Platform Handling Process and Time Limits
Upon receiving a complaint notice that meets the requirements of this guide, the platform will conduct a formal verification and necessary content comparison;
Where verification is established, the platform will promptly take measures such as deletion, blocking, or disconnection of links, and will notify the complained-of party as the circumstances require;
The platform will complete preliminary handling within 5 business days from the date of receipt of a qualified complaint; where the matter is complex or involves multi-party disputes, the handling period may be extended accordingly, and we will promptly inform you of progress;
Where materials are incomplete or the statement is unclear, the platform will notify you of the supplementation in a single communication, and the handling period will restart upon supplementation.
V. Appeal Mechanism
If the complained-of party believes its content does not constitute infringement, it may submit a written appeal to the platform after receiving the notice, and provide counter-evidence materials showing non-infringement or authorized use. The platform will, within 5 business days from the date of receipt of the appeal, make a determination in light of both parties' materials; where the appeal is upheld, the measures taken will be reversed and the content restored.
VI. Liability for Abusive Complaints
Complainants shall not make malicious, fabricated, or abusive complaints. Where malicious or fabricated complaints cause loss to the platform or the complained-of party, the complainant shall bear legal liability such as cessation of infringement and compensation for losses in accordance with the law. The platform also reserves the right to take corresponding restriction measures against accounts that repeatedly abuse the complaint process.
VII. Complaint Channels
Please send the complete complaint materials to the platform's dedicated infringement-complaint mailbox: ip@ambervouch.com (please indicate "Infringement Complaint" in the email subject), or log in and submit online through the "Complaint" entry on the relevant content page. The platform does not charge any complaint-handling fee. Liability for losses caused by wrongful complaints is governed by Section III of this guide; where the dispute enters judicial proceedings, the decision of the competent authority shall prevail.
VIII. US DMCA Channel
To allow rights holders in the United States to serve notices under 17 U.S.C. §512, the platform maintains the following dedicated channel and receiving agent:
(a) Designated agent
Function: to receive and process notifications of claimed infringement under §512(c)(3) and counter-notifications under §512(g);
Email: ip@ambervouch.com (subject line "DMCA Notice" or "DMCA Counter-Notice");
The agent registration filed with the U.S. Copyright Office is governed by that Office's public database; the platform publishes the corresponding record on this page once registration is completed or changed.
(b) Elements of a compliant notice
Under §512(c)(3) a notice must include: (1) a physical or electronic signature of the owner or an authorized agent; (2) identification of the copyrighted work claimed to have been infringed, or a representative list; (3) identification of the allegedly infringing material and information reasonably sufficient to locate it (URL); (4) information reasonably sufficient to contact the complaining party (address, telephone, email); (5) a statement of good-faith belief that the use is not authorized by the owner, its agent, or the law; and (6) a statement, under penalty of perjury, that the information is accurate and that the complaining party is the owner or is authorized to act on the owner's behalf.
(c) Counter-notice and restoration window
A counter-notice must include: a signature; identification of the removed material and its former location; a statement consenting to the jurisdiction of the federal district court for the district in which the subscriber's address is located (or, if outside the United States, any judicial district in which the platform may be found); the subscriber's address, telephone number and email; and a statement under penalty of perjury of a good-faith belief that the material was removed by mistake or misidentification;
On receipt of a compliant counter-notice the platform forwards it to the original complainant and restores the removed material within 10 to 14 business days, unless it receives notice that the complainant has filed an action seeking a court order against the subscriber.
(d) Role and limits of the platform
The platform is a provider of storage and display services and has no obligation to monitor its service or to affirmatively seek facts indicating infringing activity;
On receiving a legally compliant notice, the platform acts expeditiously to remove or disable access to the material identified;
The platform does not exercise control over infringing activity and does not receive a financial benefit directly attributable to infringing activity; repeat infringers are handled under section IX;
Where the platform removes material in good faith in reliance on a compliant notice, it is not liable to the uploading user even if the material is later found not to be infringing.
IX. Repeat Infringer Policy
The platform applies escalating measures to accounts that repeatedly infringe intellectual property rights:
Determination: an account counts a violation where a complaint is upheld and action is taken, or where a final judgment finds infringement; multiple actions arising from the same complaint count as one;
Measures: first — written warning and removal deadline; second — restriction on listing new works or suspension of trading privileges; third and later — account suspension; in serious cases (systematic, commercial or deliberately evasive conduct) or on refusal to comply, the account is terminated and the relevant works removed;
Records: the platform retains records of complaints, notices, measures taken and outcomes in order to assess repeat infringement;
Appeal: the affected account may appeal under section V; where the appeal succeeds, the measure is reversed and the violation count adjusted;
After termination: a terminated account may be refused re-registration under the same identity; obligations already incurred (such as performance of granted licences or refund duties) survive termination;
Basis: this section implements the platform's obligation under 17 U.S.C. §512(i)(1)(A) and does not limit other rights available to the platform.
Tip: Before submitting a complaint, we recommend you first use the platform's evidence-anchoring service to fix the proof of rights and the timestamp, so as to more effectively prove ownership and the facts of infringement in the complaint and subsequent enforcement.
