I. Scope of this page

This page applies to natural persons who buy the platform's digital content or digital services as a consumer (that is, for purposes outside their trade, business or profession), including licences, tier upgrades and evidence-sealing services. It does not apply to business buyers, to whom the Enterprise SaaS Terms apply.

Nothing on this page affects mandatory rights you have under applicable law. If this page conflicts with other platform terms, the provision more favourable to you prevails in respect of your consumer rights.

II. Your statutory remedies

Digital content or services supplied to you must conform to the contract (including description, functionality, compatibility, interoperability and availability period). Where they do not conform, you may require:

  1. Conformity: the platform brings the digital content or service into conformity, free of charge and within a reasonable time, without significant inconvenience to you;
  2. Price reduction: a proportionate reduction where conformity is impossible or disproportionate, where the platform fails to bring it into conformity, or where the lack of conformity is serious;
  3. Termination and refund: termination of the contract, with reimbursement made without undue delay and in any event within 14 days of your request, using the same means of payment you used and at no cost to you.

You may also claim damages for loss caused by a lack of conformity. The platform does not exclude or restrict these remedies by standard terms.

III. 14-day right of withdrawal and the digital content exception

  1. For distance contracts you normally have 14 days from conclusion of the contract to withdraw without giving any reason;
  2. Digital content exception: where you purchase digital content delivered immediately by download, your right of withdrawal is lost only if you expressly consented to performance beginning before the 14-day period expired, you acknowledged that you thereby lose your right of withdrawal, and the platform provided you with confirmation of that consent and acknowledgement;
  3. On this platform that consent and acknowledgement is captured by an explicit checkbox on the order page, and the record is retained. Where the acknowledgement is not completed, the platform does not begin delivery early and your 14-day right of withdrawal remains;
  4. Exercising withdrawal does not affect your statutory remedies under section II (for example where content does not conform to the contract).

IV. No blanket exclusion of liability

For the avoidance of doubt, the platform does not:

  1. exclude or limit its liability for death or personal injury caused by its act or omission;
  2. inappropriately exclude or limit your legal rights where the platform fails to perform, or performs inadequately, any of its contractual obligations;
  3. exclude or reduce the remedies of conformity, price reduction, termination and refund set out in section II;
  4. effectively reduce those rights by shortening limitation periods or reversing the burden of proof.

Within what the law permits, the platform may set reasonable limits in respect of indirect or consequential loss; such limits do not apply to the mandatory rights described above.

V. Applicable law and mandatory protection

Where the platform directs its activities to the country in which you are habitually resident, you benefit from the mandatory consumer protection rules of that country which cannot be derogated from by agreement. A choice of law or jurisdiction in the platform's terms does not deprive you of that protection. You may also bring proceedings before the competent body in your place of residence.

VI. Disputes and contact

  1. Please first contact support@ambervouch.com with your order number and the issue; the platform replies with a proposed resolution within 5 working days of receipt;
  2. Refund and after-sales rules are set out in the Refund and After-sales Rules; intellectual property complaints are handled under the Consumer Rights and Withdrawal Information;
  3. You may also complain to the consumer protection body or supervisory authority in your country, or assert your rights before the competent body under applicable law;
  4. This page does not replace any right conferred on you by law, and the platform makes no promise as to the outcome of any dispute.
Tip: Before submitting a complaint, we recommend you first use the platform's evidence-anchoring service to fix the proof of rights and the timestamp, so as to more effectively prove ownership and the facts of infringement in the complaint and subsequent enforcement.
